The Privacy Policy is intended to explain how QQAWIN Technologies Private Limited ("we," "QQAWIN") handles user's personal information when the user uses any QQAWIN game or service. We are committed to protecting user's privacy. We will never sell or disclose user's privacy information to third parties without the user's consent, except when necessary to provide the service the user is using. QQAWIN is required to use the personal data of all users in accordance with the applicable laws of the country where the games are being played by the Users.

What We Collect

When the User uses any QQAWIN game or service, the User is authorizing QQAWIN to access certain information of the User. The information we collect is to provide and improve our services and meet user's requirements. In each case, we will collect, store, and use the information provided by the User in accordance with this Privacy Policy. This includes User's Name, profile picture, gender, networks, user IDs, friend list, date of birth, email address, and any other information that the user has set to public on the user's Facebook.

• When the user uses any QQAWIN game or service through a social network account, such as Facebook, Apple, etc., the user is authorizing us to access certain profile information of the user for that site in accordance with the privacy settings set by the user and the user's friends, such as the user's name, address, phone number, etc., which the SNS could provide us through the SNS Application Programming Interface ("API").
• When the user uses any QQAWIN game or service directly, we may collect and store user information such as registration data, email address, and any other information that the user has provided in the user's profile.
• When the user accesses any QQAWIN game on a mobile device, we may collect information about the user's device and carrier, such as MAC address, IP address, geolocation, phone number, the account information that users associated with their device, country, or other information provided by the Users.
• If the user purchases a license to use virtual items in the game directly from any QQAWIN game, we will collect the necessary billing and financial information to process the user's charges, which may include the user's postal address and email address. QQAWIN may also receive the billing and payment information that the user provides when purchasing the order is processed by another party, such as Facebook (for Facebook Credits) or Apple (for in-app purchases on iOS devices). Our terms of service explain our relevant policies and terms for our charges and billing practices. Please note that purchases of third-party credits or currencies such as Facebook Credits may also be subject to additional policies. We do not store credit card information.
• When the user uses any QQAWIN game or service, we collect certain technical information to (i) analyze the usage of our websites and services; (ii) provide a more personalized experience; and (iii) manage advertising. We and service providers acting on our behalf, use Log Files and tracking technologies to collect and analyze certain types of technical information, including cookies, IP addresses, device type, device identifiers, browser types, browser language, referring and exit pages and URLs, platform type, the number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, game state, and the date and time of activity on our websites or games, and other similar information. In some cases, we will associate this information with the user's identification number for our internal use.
• We collect the following categories of your personal information and may sell them to third parties: identifiers, commercial information, Internet or other electronic network activity information, geolocation data, and inferences drawn from these categories.

HOW WE USE THE INFORMATION WE COLLECT?

Only QQAWIN has the right to the information. We will never sell or pass on user privacy information to third parties without the user's consent. We may use the information to notify the User about important announcements regarding our software developments, software updates, special offers, to request feedback and user input, and to provide the User with application/software support. If the User does not wish to receive any announcements from us, the User can manage the user's app notifications. The user can also request to be excluded from such announcements by sending us an email to that effect. Additionally, we may use User Information in a way that is not personally identifiable to help us analyze various aspects of user behavior for the purpose of improving our services.

Controlling the user's personal information.

The user can terminate the user's account at any time, which will remove the user's profile and other personal information from view. However, some information may be necessary to provide the User with our services and support. In this case, we may not be able to provide the User with one or more of our services that the User is using.

In QQAWIN's social games, we do not delete the results or records of previous games, even if the user deletes the user's phone application or does not log in again. QQAWIN will take reasonable measures to protect the user's personal information against loss, misuse, unauthorized access, disclosure, or unauthorized alteration. By downloading any QQAWIN software or creating an account or accessing or using the service, the user agrees and consents to be bound by these terms of service.

Exceptions to Restriction on Disclosure of Information or Account Information

User understands and agrees that we may be required to disclose any Information or Account Information by a competent legal authority or that we may voluntarily choose to disclose any such Information or Account Information under reasonable belief that this is necessary for any lawful purpose. We will be under no legal obligation to either inform User about the presence of such request or contest such a request for Information or Account Information whatsoever.

The User understands and accepts that downloading the game from QQAWIN is an action of the User by their own consent, and they will assume responsibility for system damage, data loss, and any other risks. QQAWIN and its affiliates assume no responsibility for any direct, indirect, incidental, special, and consequential damages arising from using or failing to use the QQAWIN game under any circumstances.

Granting a License to Use the Service

Subject to the user's compliance with the terms of service, QQAWIN grants users a limited, revocable, and non-exclusive license to access and use the services. This license is non-transferable. The user agrees to use the service for their own non-commercial purposes. Users play some QQAWIN social games to earn chips. Users do not play with real money. The chips that the user loses or wins have no value in real money. Sometimes, the User may "win" or "purchase" virtual items from the game. These virtual items do not refer to any real currency credit balance or its equivalent. QQAWIN reserves the right to terminate the license of any user without giving any reason. If QQAWIN believes that a user has acquired chips from sources that violate the terms of service, it has the right to withdraw all or part of the total chips from the user.

Users agree and acknowledge that the rights, title, and interest in the intellectual property rights to the game and related software shall be exclusively owned by QQAWIN. If the User engages in any infringing activity, QQAWIN has the right to terminate the user's services and take appropriate action in accordance with applicable laws for the violation of QQAWIN's intellectual property rights.

Downloading the game from QQAWIN is free. QQAWIN gives the user free chips to start with and regularly. This gives the user a limited license to play our games. If the user does not lose all the user's free chips, the user can play for an unlimited period. If the user loses the user's free chips, the user can no longer play. However, the user has the option to purchase chips and enter the game. Remember that the chips the user buys and wins have no value in real currency. These chips are non-transferable, and we do not offer refunds.

By accepting to use the application, the User understands and agrees that the User may lose chips for various reasons besides losing the game. Some of the reasons include client data connection, Internet connection, improper client behavior, QQAWIN server issue, sudden increase in traffic, someone else using the user account, or the user account being hacked, and much more.

QQAWIN is not responsible for any loss of chips due to the operation, as well as malfunctioning of its servers and software. Winning or losing mostly depends on the random cards the user receives. When the user downloads the game issued by QQAWIN, users accept and agree to play it for fun and entertainment purposes only, and QQAWIN is not liable for any damage or loss or anything else.

RULES AND RESTRICTIONS

Failure to comply with the restrictions or terms of service may result in the user's account being suspended, hacked, or permanently banned. Please read the following restrictions that apply to the use of the service:

• We recommend that individuals under 13 years of age and under 18 years of age seek permission from parents before sending any information about themselves to anyone over the Internet. The user should not use the service if the user is under 13 years of age. The user must deny anyone under 13 years of age the use of the user account. The user is fully responsible for any use of the service, including but not limited to the use of a credit card or any payment by any method.
• The user should use the user account solely for non-commercial entertainment purposes. The user must not use the service for any other purpose, such as collecting chips from multiple accounts or by any other means.
• The user must not use the user account for any illegal activity.
• The user must not use the user account to transmit repetitive messages (spam), junk mail, advertising, and solicitation.
• The user must not use profanity or language that discriminates or maliciously targets another individual in any way. This includes the user's profile picture.
• The user must not use the user account to cheat or hack the game by any means. Purposely losing as a means to transfer chips can be easily traced, and this behavior will result in the user's chips being confiscated and banned.
• The user must not sublicense, lease, trade, gift, sell, or transfer the user account or associated virtual items in whole or in part to any person without written permission from QQAWIN.

• Users may have one account per social network to use the service. Additionally, users may not use multiple accounts to try to accumulate free chips. This behavior is easily detectable and will result in all user accounts being suspended and/or banned.
• Users must not use scripts and manual processes to excessively accumulate free chips.
• Users must not use any of the services or create an account or use an account if users have been removed or banned from using the service.
• Users must not use any QQAWIN game or service if users do not agree to the terms of service, and the user's license to use the service shall terminate immediately.

The User has no right to perform actions, including but not limited to:

• Deleting all QQAWIN software copyright information and related content;
• Performing reverse engineering, reverse assembly, reverse compilation, etc., for QQAWIN's game, regardless of any purpose to plagiarize or alter QQAWIN's game software;
• For information related to QQAWIN's game software (without QQAWIN's written consent), the user may not (without authorization including, but not limited to) use, copy, modify, link, reprint, assemble, release, publish, define, create a mirror site, or use QQAWIN's game for these purposes without authorization to develop derivative products, works, or services related to the software.

The User is not allowed to host, post, display, upload, modify, copy, transmit, publish, update, share, or store the following information using QQAWIN's game:

• Information that violates any law and regulation, department regulation, or applicable local law;
• Endangering national security, disclosing state secrets, subverting state power, and undermining state unity;
• Harming national honor and interests;
• Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;
• Destroying state religious policies, promoting evil cults, and arcane superstitions;
• Insulting or slandering others and infringing on the legal rights and interests of others;
• Infringing on the intellectual property rights, trade secrets, or other legal rights of third parties;
• Information that harms minors in any way;
• Information that deceives or misleads the recipient about the origin of such messages or communicates any information that is grossly offensive or threatening in nature;
• Information that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer feature;
• Information that threatens the unity, integrity, defense, security, or sovereignty of the municipalities where the games are played by the User, friendly relations with foreign states, or public order or provokes incitement to the commission of any recognizable offense or prevents the investigation of any offense or insults any other nation.

QQAWIN reserves the right to terminate the license of any user.

Applicable Law and Jurisdiction:

• If any provision set forth in this Privacy Policy is found to be invalid, in whole or in part, it shall not affect the validity of the remaining provisions of this Privacy Policy.

The validity, performance, interpretation, and resolution of disputes arising from or in connection with this Privacy Policy and any non-contractual obligations arising from it shall be governed by the laws of the countries where the games are being played by the Users;

Any dispute arising out of the content or application of this Privacy Policy shall first be resolved by the interested parties through amicable consultation. If said dispute cannot be resolved by the parties within 30 (thirty) days of such dispute, then the dispute shall be resolved through arbitration in accordance with the provisions of the applicable laws of the host country where the games are being played.

The seat and venue of the arbitration shall be in the location where the headquarters of QQAWIN is situated. Subject to the aforementioned arbitration provisions, either party may initiate legal action on such dispute in the relevant Court with jurisdiction in the location where the headquarters of QQAWIN is situated.

GOVERNING AGREEMENT

The terms of this service govern the relationship between the user and QQAWIN (“We”) in relation to the user's use of any QQAWIN game or service (“Privacy Policy”).  Please read this Privacy Policy carefully, and if the User has any questions, feel free to contact QQAWIN. QQAWIN reserves the right to edit these terms of service and policies at any time.  We hope that the user can review the changes periodically.  The user is required to review and accept or not accept this Privacy Policy (minors, i.e., Users under 18 years old, must review and execute this Privacy Policy accompanied by a legal guardian, if the minor exercises and fulfills the rights and obligations set forth in this Privacy Policy, it will be considered that the minor has obtained the approval of the legal guardian).  Unless the user accepts the terms of this Privacy Policy, the User has no right to use the relevant products and services under this Privacy Policy. User registration and use shall be deemed to indicate that the User has accepted this Privacy Policy and agreed to be bound by the terms of this Privacy Policy.
